Please read these Terms of Service ("Terms") carefully before using the WeStay website or booking our accommodations. By accessing our website or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the WeStay website, mobile applications, or any services provided by WeStay (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree to all the Terms, you may not use the Services.

2. Service Description

WeStay provides coliving accommodation services in various locations throughout Malaysia. Our services include but are not limited to:

  • Providing shared and private accommodation in our properties
  • Access to common facilities and amenities
  • Utilities and internet service as specified in your booking
  • Property management and maintenance services
  • Community events and activities (where available)

3. Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Possess the legal authority to enter into a binding agreement
  • Comply with these Terms and all applicable local, state, national, and international laws

4. Account Registration

Some portions of our Services require you to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for any activities or actions under your account.

5. Booking and Payment Terms

5.1 Booking Process

All bookings are subject to availability and acceptance by WeStay. A booking is not confirmed until you receive a written confirmation from WeStay and full payment or the required deposit has been received.

5.2 Payment

Payment terms will be specified during the booking process. You agree to pay all fees and charges incurred in connection with your use of the Services at the rates in effect when the charges were incurred. Unless otherwise specified:

  • A security deposit may be required at the time of booking
  • Full payment or a specified deposit is required to confirm a booking
  • Monthly rent payments are due on the specified date each month
  • Late payment fees may apply as specified in your tenancy agreement

5.3 Security Deposit

A security deposit is required for all bookings. The deposit is refundable within 14 business days after the end of your stay, subject to deductions for damages, missing items, additional cleaning requirements, or outstanding charges.

5.4 Cancellation Policy

Our standard cancellation policy is as follows:

  • Cancellations made 30+ days before check-in: Full refund minus processing fees
  • Cancellations made 15-29 days before check-in: 50% refund
  • Cancellations made less than 15 days before check-in: No refund

Specific booking packages may have different cancellation terms, which will be communicated at the time of booking.

6. House Rules and Resident Responsibilities

All residents must comply with WeStay's House Rules, which form part of these Terms. The House Rules cover aspects including but not limited to noise levels, guests, cleanliness, and use of common areas. Repeated violations of House Rules may result in termination of your stay without refund.

As a resident, you are responsible for:

  • Maintaining your room in clean and orderly condition
  • Reporting any damages or maintenance issues promptly
  • Respecting the privacy and property of other residents
  • Ensuring your guests comply with House Rules
  • Using common facilities and amenities responsibly

7. Property Damage

You are responsible for any damage to the property, furniture, fixtures, or fittings caused by you or your guests, whether accidental or otherwise. WeStay reserves the right to charge for repairs, replacement, or extra cleaning required as a result of your stay.

8. Limitation of Liability

To the maximum extent permitted by applicable law, WeStay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

In no event shall WeStay's aggregate liability for all claims related to the Services exceed the greater of RM1,000 or the amount paid by you to WeStay for the past six months for the Services in question.

9. Privacy

Our Privacy Policy, available at Privacy Policy, describes how we collect, use, and share information about you when you use our website, mobile applications, and services. By using our Services, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

10. Termination

WeStay reserves the right to suspend or terminate your access to the Services at any time for any reason without notice. Upon termination:

  • Your right to use the Services will immediately cease
  • You must vacate the premises by the specified date and time
  • Any outstanding fees or charges must be paid in full
  • Your security deposit will be processed according to section 5.3

11. Modifications to Terms

WeStay reserves the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website. Your continued use of the Services after such modifications constitutes your acceptance of the modified Terms.

12. Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Malaysia.
